Third Street Electronic Disclosure and Consent Agreement

By creating an account with or using Third Street by Emigrant Bank’s website (“Site”), you agree to the terms of this Agreement. In this Agreement, "you" or "your" refers to the person(s) using the Site, "we", "us" or "our" refers to Third Street d/b/a Emigrant Bank (“Third Street” or “Emigrant Bank”) and any agent, independent contractor, designee, or assignee Emigrant Bank may, in its sole discretion, involve in the provision of this Site. 

System Requirements

In order to use the Site, you must have a computer or its equivalent with an internet connection and an internet browser that supports the level of encryption employed by the Site you are responsible for configuring your system to accommodate these requirements. Additionally, you will need an active email account and related software for accessing the email account.  Furthermore, you must have a current version of a program that accurately reads and displays PDF files. Finally, you will need a printer if you want to print copies of electronic records. Emigrant Bank may change these requirements from time to time. 

If a change in any of these requirements result in a material risk that you will not be able to receive communications and notices electronically, then we will notify you in advance by email and you will be allowed to choose whether you still want to give us your consent to receive communications or information by electronic records. You will be allowed to withdraw your consent at that time, without any fee or charge by us. However, if you withdraw your consent or fail to maintain the hardware and software requirements, you may not be able to access the Services.  

Communications and Notices

Accessing the Site means you agree to receive electronic communications in connection with the Services. These include, but are not limited to:

  • All Emigrant Bank agreements and amendments thereto;

  • All service and product disclosures;

  • Notices;

  • Privacy policies;

  • Responses to applications;

  • All legal, regulatory and other communications related to the service. 

Delivery

All communications that we send electronically will be provided either (1) in your secure message center, (2) via email, or (3) on our Site. You are required to keep your email address and other contact information up-to-date. 

Scope of Consent

Your consent applies only to your electronic receipt of communications and legal documents in connection with the application, origination, and closing of the related loan application. 

Consent

When checking the box "I have read and agree to this electronic signature disclosure agreement" you indicate your consent to the terms, conditions and responsibilities contained herein. You should keep a copy of this Agreement for your records. If you have questions about electronic records that are not answered in this Agreement, you can contact us at support@thirdstreetsba.com.

If you wish to withdraw consent, then you must contact us. By withdrawing consent, we may terminate your account and access to the Site.
